Hyde & Seek creche fighting to keep insurance following controversial RTE Investigates revelations

THE creche chain at the centre of the controversial RTE Investigates exposé is battling to stop its insurance being cancelled.

Hyde & Seek Childcare Ltd and Hyde & Seek Glasnevin Ltd want to prevent Ironshore Europe DAC cancelling policies for four creches catering for 220 children and employing 45 people following the programme and subsequent media reports.

Ironshore disputes the applicants’ claim the matter is covered by an arbitration clause in the policies terms and conditions and says it had validly served notice of cancellation of insurance.

Today, firm director Ann Davy applied for an injunction first obtained on October 24 to continue pending an intended arbitration.

The policies at issue provide cover for creches at Dublin’s Tolka Road, Pearse Street, Millbourne Avenue, Drumcondra, and Prospect Avenue, Glasnevin.

Davy disputed the insurer is entitled to avoid the policies on grounds including her failure to disclose a 2004 District Court conviction along with other adverse findings against her in 2006.

High Court judge David Barniville will give his decision next Tuesday.
